Terms of Service

These Terms of Service ("Terms") govern your use of Elemenify (the "App"), a visual page-builder app for Shopify published by Tiwaa ("we", "us", "our"). By installing or using the App, you agree to these Terms. If you do not agree, uninstall the App.

1. Use of the App

You may use the App to design, preview and publish pages, headers, footers and other sections on your Shopify storefront for your legitimate business. You must:

• Comply with Shopify's Terms of Service and applicable laws.
• Only publish content you own or are licensed to use, and not publish unlawful, infringing, deceptive or malicious content (including in Custom CSS/JS/HTML and Shortcode widgets).
• Be solely responsible for any code, scripts or third-party embeds you add through the App and their effect on your storefront.
• Not reverse-engineer, decompile, or extract the App's source code; not impair our or Shopify's infrastructure; not resell or sublicense access.

2. Forms & Visitor Data

If you use the Form widget, you are the data controller for personal data your visitors submit. You are responsible for displaying appropriate notices, obtaining any required consent, and having a lawful basis to collect that data. We process such submissions on your behalf as described in our Privacy Policy. Any third-party integrations you enable (Mailchimp, Klaviyo, webhooks, Shopify customer creation) are configured at your discretion and subject to those providers' terms.

3. Account & Billing

The App offers a free trial. After the trial, a paid subscription is required to continue using paid functionality. All billing is handled by Shopify through the Shopify Billing API — we never process payment-card data directly.

Subscriptions are charged in advance for each billing period. You may cancel any time from your Shopify admin; access continues until the end of the paid period. Except where required by law, fees are non-refundable for partial periods.

4. Intellectual Property

The App and all related software, design and code are the exclusive property of Tiwaa and are protected by intellectual-property laws. These Terms grant you a limited, non-exclusive, non-transferable right to use the App while your subscription is active; they grant no ownership in the App.

You retain ownership of the content and designs you create and of your store data. By using the App you grant us a limited licence to access and process your store data solely to provide the App's functionality. Prebuilt sections, pages and template kits are provided for use within your store via the App.

5. Storefront Delivery

Regular pages are published through the Shopify Pages API. Global sections (header, footer, promo, etc.) are delivered through the Shopify App Proxy and require you to enable the "Elemenify Globals" app embed in your theme. The App does not modify your theme's code files. You are responsible for enabling the app embed and for testing your published pages.

6. Availability & Support

We aim for high availability but do not guarantee uninterrupted service. Planned maintenance will be communicated where possible. Support is available via email at tiwaaofficial@gmail.com; we target a response within 1 business day.

7. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be error-free, that defects will be corrected, or that published pages will render identically across every theme.

8. Limitation of Liability

To the maximum extent permitted by law, Tiwaa's total liability for any claims arising from your use of the App shall not exceed the amounts you paid to us in the 3 months preceding the claim. We are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, revenue or profits.

9. Termination

We may suspend or terminate access if you materially breach these Terms or if we discontinue the App. On uninstall or termination, your data is deleted in accordance with our Privacy Policy. Published Shopify pages remain under your control in your Shopify admin.

10. Governing Law

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Disputes are subject to the exclusive jurisdiction of the courts of India.

11. Changes

We may update these Terms from time to time. Material changes will be communicated via the App or email. Continued use after the effective date constitutes acceptance.
